Terms of Service — PhotX

1. Acceptance of these terms

By creating an account or using PhotX ("the Platform," "we," "us"), you agree to these Terms of Service. If you're using the Platform on behalf of a business, you confirm you have the authority to bind that business to these terms.

2. What PhotX does

PhotX is an AI-assisted photography service for merchants (currently restaurants and cafés). You upload a real photo of an item you already have — your dish, drink, or product — along with a chosen background, and our system produces a professionally enhanced photograph of that same item. PhotX re-photographs your real product; it does not invent, design, or fabricate a new one. Results are AI-generated and may occasionally not meet expectations — see Section 6 (AI-generated content).

3. Accounts

• You must provide accurate information when creating an account.
• You're responsible for keeping your login credentials secure and for all activity under your account.
• You must have the right to use any brand name, logo, product, or content you upload — see Section 5 (Acceptable use).
• Accounts may be created via email/password or Google sign-in.

4. Credits and billing

4.1 How credits work

• Credits are purchased in packages via our e-commerce payment partner, [PAYMENT PLATFORM NAME], and applied to your PhotX wallet.
• 1 credit = 1 generated photo.
• Credit packages, pricing, and any promotional bundles are listed on our pricing page and may change at our discretion; the price you paid for previously purchased credits does not change retroactively.

4.2 When a credit is deducted — read this carefully

A credit is deducted only when a result is successfully generated, passes review, and is delivered to you. Specifically:

• No credit is deducted if your submission fails the automatic pre-generation check (for example, a missing or unclear reference photo) and you have not chosen to proceed anyway.
• No credit is deducted if a generation attempt fails on our side (a technical error) or is rejected during our quality review and is never delivered to you.
• A credit is deducted the moment a result passes review and is delivered to your account, regardless of whether you are personally satisfied with the artistic result — see Section 4.3.
• If you choose to proceed with generation despite a feasibility warning (i.e. you clicked "generate anyway" after being told something was missing or unclear), a credit is deducted upon delivery the same as any other successful generation, since you made an informed choice to continue.

4.3 No credit refunds for subjective dissatisfaction

Because PhotX re-photographs your real product rather than inventing a new one, a delivered result that accurately reflects your uploaded reference photo and chosen background is considered a successful generation, even if you would have preferred a different creative outcome. If you want a different result, submitting a new item (or the same item with an updated description) is a new generation and costs a new credit. We do not currently offer an editing/regeneration feature that reuses a credit.

4.4 Credit expiry

[DECIDE: do purchased credits expire after a period of time, or remain valid indefinitely? State the policy here before publishing. If none is stated, credits are treated as non-expiring.]

4.5 Refunds

Purchased credit packages are generally non-refundable once payment is completed, except: (a) where required by applicable law, or (b) at our discretion in cases of a verified platform error (for example, a technical failure that incorrectly deducted a credit without delivering a result). 4.6 Payment processing

Payment is handled entirely by our third-party e-commerce partner, not directly by PhotX. We do not store your payment card details. Crediting of your PhotX wallet after payment may not be instantaneous — see our support page for current processing times.

5. Acceptable use

You agree not to:

• Upload content you don't own or don't have permission to use, including third-party branded products, copyrighted material, or trademarks you're not authorized to use.
• Upload illegal, offensive, or harmful content.
• Attempt to use the Platform to generate misleading product representations (for example, an item that materially misrepresents what a customer would actually receive).
• Attempt to circumvent, abuse, or exploit the credit system, including creating multiple accounts to farm free-credit signup bonuses.
• Use the Platform to violate any applicable law or third party's rights.

We may suspend or terminate accounts that violate this section, at our discretion.

6. AI-generated content — please understand these limitations

• Results are produced by AI image generation technology and, while designed to faithfully reproduce your real product, may occasionally contain imperfections or artifacts.
• We apply an automated pre-generation check and, currently, human quality review before delivery, but we cannot guarantee every result will be flawless.
• You are responsible for reviewing delivered images before using them in your own marketing, menus, or advertising, and for ensuring they accurately represent what customers will actually receive.

7. Intellectual property

• Your content: you retain all rights to the reference photos, brand assets, and other content you upload. You grant PhotX a limited license to use that content solely to provide the generation service to you.
• Generated results: subject to full payment of the associated credit, you own the delivered result and may use it for your business purposes.
• The Platform: PhotX's software, design, and underlying technology remain our property (or that of our licensors, including our AI provider).

8. Service availability

We aim to keep the Platform available and reliable but do not guarantee uninterrupted service. We are not liable for downtime, delays, or interruptions beyond our reasonable control.

9. Limitation of liability

To the maximum extent permitted by applicable law, PhotX is not liable for indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability for any claim is limited to the amount you paid for the specific credits related to that claim. 10. Termination

You may close your account at any time. We may suspend or terminate your account for violation of these terms, suspected fraud or abuse, or as required by law. Unused credits at termination are handled per Section 4.5.

11. Governing law

These terms are governed by the laws of the Kingdom of Saudi Arabia. [Confirm jurisdiction/dispute resolution mechanism with legal counsel.]

12. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via [email / in-app notice]. Continued use of the Platform after changes take effect constitutes acceptance.
